Terms of Use

1. INTRODUCTION

These Terms of Use establish the legal conditions under which individuals and organizations may access and use the Globe Communication platform. By registering an account, accessing any portion of the service, submitting information, initiating campaigns, interacting with system dashboards, or integrating external applications through APIs or other technical methods, you accept these terms in full and agree to comply with all obligations described herein. These terms apply equally to all categories of users, including administrators, employees, agents, partners, resellers, and individuals authorized to operate on behalf of a business entity. If you do not agree with these Terms of Use, you must discontinue using the platform immediately, as continued usage constitutes acknowledgment and acceptance of all legal obligations outlined in this document.

Globe Communication is designed as an enterprise-grade communication and automation ecosystem, enabling functions such as account authentication, business verification, campaign creation, message transmission, media handling, reporting, analytics, support ticketing, and other operational processes necessary for digital communication management. These Terms explain the framework that governs how the platform may be used, how rights and responsibilities are allocated, and what limitations and safeguards apply when interacting with the system or transmitting any form of content through it. The objective of these Terms is to maintain a lawful, transparent, stable, and secure environment that protects both users and the platform from misuse, violations, or unauthorized activities.

Globe Communication may update or modify these Terms periodically to reflect system upgrades, regulatory changes, improved security controls, or enhancements in platform functionality. Users are responsible for reviewing these Terms from time to time to ensure continued compliance. Continued access or usage of the platform following modifications represents acceptance of the updated Terms of Use. This document forms the primary legal agreement governing all platform interactions and replaces any prior terms unless explicitly stated otherwise.

2. ACCEPTANCE OF TERMS

By creating an account, accessing the platform, or using any feature provided by Globe Communication, you confirm that you are legally capable of entering into binding agreements and are authorized to act on behalf of yourself or your organization. Your acceptance of these terms occurs the moment you use any component of the platform, including visiting the website, logging into your dashboard, sending a message, uploading content, or integrating APIs. If you are acting on behalf of a company or institution, you represent that you have the authority to bind that entity to these Terms of Use. If you do not possess the required authority, you must refrain from using the platform until such authorization is formally granted.

Your acceptance applies to all features, services, tools, and technologies made available by Globe Communication, whether accessed through the website, the dashboard, mobile interfaces, APIs, or any other channels. You acknowledge that your use of the platform must remain lawful and must comply with all applicable rules, regulations, and industry guidelines governing communication, data handling, business verification, and message distribution. You further acknowledge that your acceptance of these Terms includes acceptance of any policies incorporated by reference, including the Privacy Policy, compliance guidelines, usage restrictions, and technical documentation.

You understand that Globe Communication may update, modify, or revise the Terms of Use at any time in response to legal requirements, platform enhancements, or operational needs. Continued use of the service after updates signifies acceptance of the revised terms, and you agree to review these Terms periodically to remain informed. If you disagree with any changes, you must discontinue use of the platform and request account closure. Your acceptance of these Terms establishes a binding contractual relationship that governs all activities conducted through Globe Communication.

3. USER ACCOUNT RESPONSIBILITIES

When creating an account on Globe Communication, you agree to provide accurate, complete, and up-to-date information, including personal details, company credentials, verification documents, and any other information required during registration. You are responsible for maintaining the confidentiality of your login credentials, including your username, password, authentication codes, and any security tokens provided for system access. Any activity performed under your account is deemed to have been carried out by you or with your authorization, and you are fully responsible for all actions, submissions, transmissions, or changes made within your account.

You must ensure that your account is used only for lawful purposes and that all communication sent through the platform complies with applicable regulations, business communication standards, and content guidelines. You agree not to share your access credentials with unauthorized individuals, and you must notify Globe Communication immediately if you believe your account has been compromised or accessed without permission. Failure to maintain proper account security may lead to suspension, termination, or legal consequences depending on the severity of the breach.

You are responsible for managing access roles within your organization, ensuring that only authorized personnel have permission to perform actions such as uploading data, sending campaigns, modifying company details, or integrating APIs. If you grant access to other individuals within your organization, you assume full responsibility for their actions as long as they operate under your account or business entity. You must ensure all users comply with the Terms of Use, maintain the integrity of the data they handle, and operate the platform ethically and securely. Globe Communication reserves the right to verify or audit account activity to ensure compliance and protect the platform from misuse.

4. PLATFORM USAGE GUIDELINES

Your use of Globe Communication must comply with operational standards, ethical requirements, and legal obligations that govern enterprise communication systems. You agree to use the platform only for legitimate business purposes and in ways that do not disrupt system functionality, compromise security, or violate the rights of other users. You must not attempt to reverse engineer, modify, bypass, or interfere with platform mechanisms, security features, or communication protocols. Any attempt to exploit vulnerabilities, manipulate system behavior, or use automated scripts that overload or disrupt infrastructure is strictly prohibited.

You acknowledge that the platform is designed to support regulated communication workflows and that your actions must adhere to rules related to message content, sender identity, required consents, and data accuracy. You may not submit false information, impersonate individuals, misrepresent your organization, or transmit misleading or harmful content. You further agree not to use the platform to store or distribute malicious files, harmful code, unauthorized scripts, or any material that threatens system stability or user security.

You are responsible for ensuring that your use of APIs, integrations, and automated systems does not send unauthorized requests, exceed reasonable usage thresholds, or impose excessive load on platform resources. Any misuse of technical interfaces may lead to temporary or permanent restrictions. You must follow all documentation, guidelines, or instructions provided for system usage and refrain from activities that violate communication laws, platform policies, or rights belonging to Globe Communication or third parties.

The platform may monitor logs, metadata, and operational behavior to detect misuse or non-compliance. By using the service, you consent to this monitoring as part of security and operational oversight. Violation of usage guidelines may result in warnings, restrictions, account termination, or legal action when necessary to protect the platform and its users.

5. BUSINESS VERIFICATION REQUIREMENTS

To maintain compliance with industry regulations and ensure responsible communication practices, Globe Communication may require businesses to undergo verification procedures before accessing certain features or sending regulated communication. You agree to submit authentic documents such as company registration certificates, GST details, PAN information, identity proofs, authorized signatory details, and any additional documents required based on your region, industry, or communication category. Verification may include reviewing your business purpose, communication intentions, website details, brand name, and operational legitimacy.

You acknowledge that verification is mandatory for accessing specific functionalities such as sender ID activation, template approvals, brand submissions, bot creation, API integrations, and large-scale messaging operations. Globe Communication reserves the right to request additional information if initial documents appear incorrect, inconsistent, incomplete, or insufficient to establish authenticity. Failure to provide required documentation may result in limited access, delayed approvals, or suspension of critical platform features.

You agree that the information submitted for verification must be true, accurate, and legally valid. Any attempt to submit falsified, manipulated, or misleading documents constitutes a violation of these Terms and may lead to account termination or legal proceedings. Verification does not imply endorsement of your business but is a regulatory measure to ensure lawful communication practices and platform security.

Globe Communication may periodically review or revalidate your information to ensure ongoing compliance. You must update your business details promptly whenever there are changes to ownership, contact details, legal status, or registered information. Continued use of the platform signifies your acceptance of these verification requirements and your commitment to maintaining accuracy and transparency throughout your association with Globe Communication.

6. SERVICE ACCESS AND AVAILABILITY

Globe Communication provides access to its platform on an as-available basis and does not guarantee uninterrupted, error-free, or delay-free operations. While every reasonable effort is made to maintain high availability, system uptime may occasionally be affected by scheduled maintenance, emergency repairs, infrastructure upgrades, unforeseen technical issues, or disruptions caused by external networks, operators, or service partners. By using the platform, you acknowledge that temporary interruptions may occur and that such occurrences do not constitute a breach of these Terms. You agree that Globe Communication shall not be held liable for any delays, performance drops, or service unavailability arising from situations outside its direct control.

You understand that access to the platform depends on factors such as internet connectivity, device compatibility, browser performance, API stability, and the operational status of third-party telecom partners. Any limitations, restrictions, or failures in these external systems may affect the delivery of messages, campaign execution, template approvals, verification status updates, and other communication functions. Globe Communication may modify or enhance system components at any time and may introduce new features or retire existing ones when required for compliance, efficiency, or improved performance.

Users are responsible for ensuring that their devices, networks, authentication tools, and integrated systems are compatible with the platform. You must not attempt to access the system through unauthorized interfaces, legacy methods, or modified tools that circumvent intended functionality. Globe Communication may temporarily restrict access to protect security, prevent misuse, or address operational concerns. In such cases, reasonable notice may be provided when possible.

You acknowledge that service availability is influenced by multiple operational layers and may not always be predictable. Your continued use of the platform signifies acceptance of these conditions and your understanding that Globe Communication is not obligated to compensate for delays, disruptions, or downtime unless explicitly stated in a separate written agreement.

7. PROHIBITED ACTIVITIES

Users of Globe Communication must adhere to lawful communication standards and refrain from any activity that threatens platform integrity, security, or regulatory compliance. You are strictly prohibited from using the system to transmit fraudulent messages, misleading content, harmful material, unauthorized advertisements, phishing attempts, abusive language, or any content intended to deceive, manipulate, or exploit recipients. You may not impersonate individuals, brands, or institutions, nor may you attempt to bypass verification procedures or submit false information to gain access to restricted features.

You are prohibited from engaging in activities that compromise platform stability, such as launching automated attacks, injecting malicious code, extracting data without permission, scraping system components, interfering with APIs, or attempting to exploit vulnerabilities. Any effort to decompile, reverse-engineer, or replicate platform functionalities without explicit authorization is considered a serious violation of these Terms. You must not use the platform for sending unauthorized bulk communication, circumventing opt-out requirements, or engaging in practices that violate spam regulations or telecom guidelines.

You may not misuse dashboards, logs, reports, or third-party integrations to obtain unauthorized information about other users, network behavior, or system configurations. Attempts to modify or manipulate billing mechanisms, credit usage, or token recharge processes are strictly prohibited. You also agree not to use the platform for activities that violate intellectual property laws, confidentiality requirements, or data protection regulations.

Globe Communication reserves the right to suspend or terminate access if prohibited behavior is detected or suspected. Investigations may be supported by log analysis, activity monitoring, or cooperation with external authorities where legally required. Your continued use of the platform requires strict compliance with all restrictions outlined in this section and acknowledgment that violations may result in legal consequences, financial liabilities, or permanent removal from the system.

8. MESSAGE AND CAMPAIGN COMPLIANCE

Messages transmitted through the Globe Communication platform must comply with industry regulations, lawful communication standards, telecom operator guidelines, and any content restrictions specific to the recipient’s jurisdiction. You agree that every message, template, or campaign you create, upload, or transmit must be truthful, accurate, and aligned with the nature of your approved business. You are responsible for ensuring that your communications do not infringe upon privacy rights, mislead users, or violate consent requirements. All campaigns must be sent to recipients who have provided valid consent where applicable, and you must maintain accurate records of such consents as required by law.

You acknowledge that campaigns must adhere to content classification standards, including promotional, transactional, informational, and service-related categories. Messages must not contain prohibited keywords, offensive material, fraudulent claims, illegal offers, or content that may cause reputational harm to the platform, network partners, or recipients. You agree that Globe Communication, telecom operators, and regulatory bodies may review your templates, campaign details, and message formats for compliance and may reject or suspend content that violates applicable guidelines.

You understand that message delivery depends on compliance with technical parameters such as character limits, media size, file formats, API structures, and operator requirements. Any message that fails to meet such criteria may be delayed, blocked, or discarded by the system or external networks. You are responsible for reviewing approval statuses, monitoring campaign behavior, and ensuring that all sent messages comply with validated templates and approved sender information.

Globe Communication may impose restrictions, review submissions, or require modifications if your communication patterns show signs of non-compliance or present a regulatory risk. You agree that failure to comply may result in account limitations, content rejection, message blocking, or termination of access without liability on the part of Globe Communication. Your use of the platform signifies ongoing commitment to lawful and responsible communication practices.

9. DATA SECURITY AND CONFIDENTIALITY

Globe Communication implements comprehensive measures to safeguard the information stored, transmitted, or processed through the platform. By using the service, you agree to handle all data with confidentiality and responsibility, ensuring compliance with applicable privacy laws, regulatory requirements, and internal security protocols. You must not disclose, share, or misuse information obtained from the platform, including customer data, campaign records, reports, logs, or any other sensitive material accessible through your account. You acknowledge that unauthorized access, disclosure, or misuse of information may result in legal penalties and termination of your account.

You are responsible for adopting adequate security measures within your organization, including secure devices, protected networks, controlled user access, and appropriate identity verification methods. Any breach resulting from negligence, weak passwords, misuse of credentials, or improper access controls remains your responsibility. If you suspect that your account or data may have been compromised, you must notify Globe Communication immediately so appropriate action can be taken to mitigate security risks.

The platform may implement encryption, access controls, monitoring systems, and automated alerts to protect data integrity and detect suspicious behavior. By using the platform, you consent to such measures as essential components of system security. Globe Communication may also limit access, restrict usage, or suspend features if security risks are detected or if actions appear inconsistent with expected behavior.

You acknowledge that the platform may store and process data on secure servers and may engage trusted third-party providers for hosting, analytics, security monitoring, or telecom integrations. Such providers operate under strict confidentiality obligations. Your continued use of the platform constitutes agreement with all security and confidentiality requirements outlined in this section and recognition that safeguarding access is a shared responsibility between you and Globe Communication.

10. INTELLECTUAL PROPERTY RIGHTS

All technology, software, interfaces, dashboards, designs, trademarks, text, media elements, code structures, APIs, documentation, and other proprietary materials made available through Globe Communication are protected by intellectual property laws. You acknowledge that these assets belong solely to Globe Communication or to its licensors and are provided for your authorized use only. You are granted a limited, nontransferable, revocable license to access and use the platform in accordance with these Terms of Use. This license does not grant ownership rights, nor does it permit copying, redistribution, modification, decompilation, or reverse engineering of any component of the platform.

You agree not to create derivative works, replicate system functionalities, or develop competing services using information, designs, workflows, or features accessible through your account. All branding, trade names, service marks, and logos displayed on the platform remain exclusive property of their respective owners and may not be used without written permission. You may not remove, alter, or obscure copyright notices, legal disclaimers, or branding elements included in any part of the platform or exported documentation.

User-generated materials such as templates, campaign content, uploaded media, and business details remain your responsibility. By submitting such materials, you grant Globe Communication a nonexclusive license to store, process, transmit, review, or use the content solely for the purpose of providing platform functionality and ensuring compliance. You confirm that your submitted content does not violate any third-party intellectual property rights, and you agree to be liable for any infringement resulting from your submissions.

Globe Communication reserves all rights that are not explicitly granted. Any unauthorized use of intellectual property may result in legal action, termination of access, or financial liabilities. Your continued use of the platform signifies acknowledgment of these intellectual property protections and agreement to respect the proprietary nature of all system components.

11. Third-Party Services and Integrations

The platform may provide access to or integrate with various third-party applications, tools, APIs, or service providers for the purpose of enhancing communication, enabling automation, processing payments, delivering notifications, or supporting other operational functionalities. By using the platform, the user acknowledges that such third-party services operate under their own legal terms, privacy practices, and usage conditions. The company does not control and is not responsible for the accuracy, performance, reliability, or availability of third-party systems, nor does it endorse or guarantee any outcomes derived from their use. Any interaction with third-party systems remains solely between the user and the respective provider, and the company shall not be held liable for any losses, damages, delays, or interruptions arising from third-party failures, configuration issues, policy changes, pricing variations, or service discontinuations. Users are responsible for reviewing the applicable terms of integrated services before enabling or relying upon them within the platform.

Where third-party services are essential for feature execution, such as SMS delivery, email transmission, cloud storage, content moderation, or authentication, users agree that the company may transmit necessary information to the respective provider in order to fulfill service requests. The user also acknowledges that certain functionalities may become limited, altered, or inaccessible if a third-party system experiences downtime or modifies its operational policies. The company reserves the right to add, modify, suspend, or remove third-party integrations at its discretion, without obligation to provide prior notice, provided that such changes do not violate applicable law. Continued use of the platform after such modifications constitutes acceptance of those changes. The user agrees that the company shall not be responsible for disputes, errors, or data issues originating from third-party platforms and that any claims related to such services must be directed to the respective provider.

12. Limitations of Liability

To the maximum extent permitted under applicable law, the company, including its directors, employees, contractors, and affiliates, shall not be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or connected to the user's access to or use of the platform. This includes, without limitation, damages related to data loss, business interruption, loss of profits, communication failures, system delays, unauthorized access, account compromise, or reliance on transmitted information. The user acknowledges that digital communication systems inherently involve factors beyond the company’s control, such as network instability, hardware limitations, third-party service performance, and user-side technical issues, and therefore accepts that the company cannot guarantee uninterrupted or error-free operation.

The company shall not be liable for any losses caused by misuse of the platform, incorrect configuration by the user, violations of law by the user, or negligence in maintaining secure access credentials. In jurisdictions where certain liability exclusions cannot be fully enforced, the company’s total liability shall be limited strictly to the amount paid by the user during the twelve months preceding the incident giving rise to the claim. If the user has not paid for the service, liability shall be limited to the minimum amount permitted by law. The user agrees that any claim must be brought within one year of the event, after which it shall be permanently barred. These limitations apply regardless of the legal theory invoked, whether contract, tort, negligence, statutory claim, or otherwise, and remain valid even if the company has been advised of the possibility of such damages.

13. Indemnification

The user agrees to indemnify, defend, and hold harmless the company, its affiliates, directors, employees, partners, and service providers from any claims, liabilities, damages, losses, penalties, legal fees, or expenses arising from or related to the user’s access to or use of the platform. This includes actions resulting from breach of these Terms of Use, violation of applicable laws, misuse of communication channels, unauthorized data transmission, infringement of intellectual property rights, or any content sent, uploaded, or distributed through the platform by the user. The user acknowledges that the company provides a technical interface for communication and shall not be responsible for disputes, contractual conflicts, or compliance failures originating from the user’s independent actions.

In the event of a third-party claim, investigation, audit, or legal proceeding arising due to the user’s conduct, the company reserves the right to participate in the defense process at its own discretion and expense. The user must cooperate fully in providing documents, system logs, communication records, and any information reasonably required for resolving the dispute. The company may, at its discretion, assume exclusive control of the defense or settlement process, in which case the user shall not agree to any settlement that imposes obligations or liabilities on the company without prior written consent. This indemnification obligation remains in effect even after termination of the user account or discontinuation of services and survives as long as claims may legally be initiated.

14. Suspension and Termination of Services

The company reserves the right to modify, suspend, restrict, or terminate user access to the platform at any time if it determines, at its sole discretion, that the user has violated these Terms of Use, engaged in unlawful activities, misused system resources, compromised platform security, exceeded fair usage limits, or acted in a manner harmful to other users or the company. Suspension may occur with or without prior notice depending on the severity and nature of the violation. During suspension, certain features or the entire platform may become inaccessible, and the user shall remain responsible for all outstanding payments or obligations incurred prior to the date of suspension.

Termination may be initiated by either the user or the company. If the user requests termination, all stored data, communication logs, and configurations may be permanently deleted according to the data retention policy. The company is not responsible for recovering deleted information once the termination process is completed. In cases of termination due to breach or misconduct, the company may deny re-registration or future access to the platform. The company also reserves the right to terminate services in whole or in part if required by law, regulatory direction, or changes in third-party provider policies. Following termination, any provisions that by their nature are intended to survive—such as intellectual property rights, warranty disclaimers, limitations of liability, and indemnification clauses—shall continue to remain in effect.

15. Governing Law and Jurisdiction

These Terms of Use shall be governed by and interpreted in accordance with the laws applicable in the governing jurisdiction specified by the company, without regard to conflict-of-law principles. By using the platform, the user agrees that any disputes, claims, or legal proceedings arising from or related to the use of the services shall fall exclusively under the jurisdiction of the courts designated by the company. The user expressly waives objections based on inconvenience of forum or lack of personal jurisdiction. If any regulatory authority requires compliance actions that affect the enforcement or applicability of these terms, the company may revise or adapt specific provisions without waiving the validity of the remaining terms.

In the event of any dispute, both parties shall first attempt to resolve the issue through good-faith negotiation. If such negotiation fails, the matter shall be pursued through the appropriate legal process in the designated jurisdiction. The invalidity or unenforceability of any individual section shall not affect the remainder of these terms, and all remaining provisions shall continue in full force and effect. Continued use of the platform constitutes acceptance of this governing framework and acknowledgment that the chosen jurisdiction shall have exclusive authority over all matters connected to the services.

16. Changes to Terms and Service Modifications

The company reserves the unrestricted right to amend, modify, revise, or update these Terms of Use at any time as required to reflect changes in technology, regulatory landscapes, operational policies, business decisions, or platform enhancements. Any updates may be made without prior notice, although the company may, at its discretion, display notifications or publish the changes within the platform interface. The user acknowledges that it is their responsibility to regularly review these Terms to remain informed of any alterations. Continued use of the platform after updates are published shall constitute full acceptance of the revised terms, and the user agrees to be bound by them in their entirety. If the user does not agree with the updated version, they must discontinue usage of the service immediately.

The company may also modify or discontinue features, functionalities, interface components, access levels, or operational capabilities either temporarily or permanently. Such modifications may include changes to communication channels, analytics tools, system integrations, message-routing mechanisms, or account management features. The company does not guarantee the continued availability of any specific feature and shall not be liable for any inconvenience, loss of data, workflow changes, or business disruptions resulting from such modifications. The user acknowledges that updates may require changes to their internal workflows, system configurations, or technical integrations and agrees to implement such adjustments at their own cost and responsibility. The company is not obligated to provide backward compatibility, legacy support, or alternative tools when discontinuing features. The user’s continued use of the platform implies acceptance of all modifications and constitutes agreement to adapt to the evolving nature of the service. These provisions ensure that the platform remains secure, compliant, and aligned with industry standards while enabling the company to introduce improvements and address technological requirements.

17. Dispute Resolution and Arbitration

In the event of any dispute, disagreement, or claim arising from the user’s access to or use of the platform, or concerning the interpretation, breach, or enforcement of these Terms of Use, both parties agree to first attempt resolution through direct communication and good-faith negotiation. If such negotiation does not resolve the issue within a reasonable timeframe, the matter shall proceed to a formal dispute resolution process as determined by the company’s governing jurisdiction. The user agrees that arbitration shall be the preferred method for resolving disputes whenever legally permissible, and such arbitration shall be conducted by a neutral arbitrator appointed in accordance with applicable laws or arbitration rules.

The arbitration process shall be confidential, and all proceedings, documents, and outcomes shall remain undisclosed except where disclosure is required by law. Each party shall bear its own legal expenses unless the arbitrator directs otherwise based on the nature of the dispute. The arbitrator’s decision shall be binding and enforceable in any competent court within the designated jurisdiction. If arbitration is not applicable due to legal or regulatory restrictions, disputes shall be resolved exclusively through the courts identified under the governing law section of these terms. The user waives any right to participate in class actions, collective proceedings, or joint claims against the company, acknowledging that all disputes must be pursued individually. By using the platform, the user consents to these dispute resolution procedures and agrees that they provide the exclusive mechanism for addressing legal or contractual conflicts.

18. Service Disclaimers

The platform and all services provided through Globe Communication are offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied. The company disclaims all warranties related to accuracy, reliability, availability, timeliness, performance, or suitability of the platform for any specific purpose. The user acknowledges that the company does not guarantee uninterrupted service, error-free operation, message delivery certainty, or complete protection against unauthorized access, cyber threats, or technical failures. While the company employs best practices to ensure system stability and data security, it cannot guarantee absolute protection against system vulnerabilities, network outages, third-party disruptions, or unforeseen operational challenges.

The company does not warrant that data transmitted through the platform will reach recipients without delay, that integrations will function continuously, or that analytics and reporting will always reflect real-time accuracy. The user assumes full responsibility for verifying critical data, maintaining internal backups, and ensuring compliance with legal and industry-specific requirements related to communication. The company does not guarantee compatibility with user-provided software, hardware, APIs, or network configurations. Any reliance on platform outputs, recommendations, analytics, or system-generated insights is undertaken at the user’s own risk. No information provided through customer support, documentation, or advisory communication shall constitute a warranty unless explicitly confirmed in writing. These disclaimers remain in force even after the termination of user accounts and shall apply to all past, present, and future use of the platform.

19. No Waiver

The failure of the company to enforce any provision of these Terms of Use shall not be construed as a waiver of such provision or the right to enforce it at a later date. Any waiver of rights or remedies must be provided expressly in writing and signed by an authorized representative of the company. The user acknowledges that no act, omission, or delay shall be interpreted as a waiver of any rights afforded to the company under these terms. A single or partial exercise of a right shall not prevent the future exercise of the same or any other right. These protections ensure that the company retains full legal authority to enforce compliance, seek remedies for breaches, and apply corrective actions whenever necessary.

The user further acknowledges that any leniency, accommodation, or tolerance demonstrated by the company in response to minor violations or technical errors does not constitute a permanent acceptance of such behavior. The company may, at any time, choose to enforce compliance strictly and take necessary action to protect the platform’s security, integrity, and operational consistency. No waiver shall apply to future breaches, similar incidents, or unrelated issues, and all provisions shall continue in effect unless explicitly modified through a documented amendment. This section protects the company from any interpretation that might restrict its ability to enforce these Terms fully.

20. Severability

If any provision of these Terms of Use is found to be invalid, unenforceable, or unlawful by a court or regulatory authority with appropriate jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent. If modification is not possible, the provision shall be deemed severed from the terms without affecting the validity and enforceability of the remaining sections. The user agrees that the removal of one provision does not impair the effectiveness or legal force of the rest of the agreement, which shall continue to govern the relationship between the parties.

The parties further agree that any removed or altered provision shall not impact responsibilities, liabilities, or rights that have already arisen under these terms. If a regulatory change, legal mandate, or industry requirement renders any clause unenforceable, the company may update or replace the provision to restore compliance without requiring user approval. Continued use of the platform after such adjustments signifies acceptance of the revised wording. This severability clause ensures the continuity of these Terms of Use despite changes in legal interpretations or regulatory conditions.

21. Notices and Communication

All official notices, alerts, updates, or communications required under these Terms of Use shall be issued through the communication channels designated by the company, which may include email, in-platform notifications, dashboard messages, system pop-ups, or public announcements on the company’s website. The user acknowledges that such communications shall be considered legally valid and binding once transmitted by the company, regardless of whether the user has viewed or acknowledged them. It is the user’s responsibility to maintain updated contact details, monitor communication channels regularly, and ensure that email filters or technical configurations do not block or delay system messages. The company shall not be liable for any losses arising from missed notices due to outdated user information or technical restrictions on the user’s devices or networks.

The user may also contact the company through the officially designated support channels. Communications sent through unauthorized or informal methods may not be recognized for legal purposes. In cases requiring legal notice, such communication must be submitted in writing to the company’s registered address or official email as specified by the company. The company reserves the right to modify its communication procedures at its discretion, and such modifications shall become effective once published. These provisions ensure that all parties maintain a reliable and traceable method of exchanging essential information related to the platform and its terms.

22. Assignment of Rights

The user acknowledges that the company may assign, transfer, or delegate its rights and obligations under these Terms of Use to any subsidiary, affiliate, successor entity, or authorized third party, whether through restructuring, acquisition, merger, or operational expansion. Such assignment may occur without the need for prior notice or consent, provided it does not diminish the user’s rights under applicable law. The user agrees that continued use of the platform after such assignment constitutes acceptance of the new entity as the legal party responsible for managing and operating the services.

By contrast, the user may not assign, transfer, or sublicense their rights or obligations under these Terms without obtaining prior written consent from the company. Unauthorized assignment attempts shall be considered void and may result in termination of services. These restrictions are intended to prevent unauthorized access, protect platform integrity, and ensure that the contractual relationship remains consistent and enforceable. The company retains full discretion to determine whether a requested assignment by the user is permissible and may impose conditions or deny such requests based on operational, legal, or compliance factors. These provisions safeguard the stability of contractual obligations and ensure that the platform’s terms remain enforceable across organizational transitions.

23. Relationship Between Parties

Nothing contained in these Terms of Use shall be interpreted as creating a partnership, joint venture, employment relationship, franchise, fiduciary duty, or agency relationship between the user and the company. The platform is provided strictly as a service, and the user engages with it as an independent entity. The company does not control the user’s business decisions, communication strategies, or use of transmitted content, and therefore bears no responsibility for operational choices made by the user while utilizing the platform. The user agrees that they shall not represent themselves as an agent, representative, or affiliate of the company without express written permission.

The relationship established here is contractual in nature and limited solely to the terms governing access to and use of the platform. The company does not assume responsibility for user-generated content, customer interactions, internal processes, or compliance obligations. The user acknowledges that all regulatory, professional, and operational responsibilities remain exclusively their own and that the company’s role is confined to providing technical infrastructure and support services. This distinction ensures clear boundaries between the parties and prevents misinterpretation of rights, responsibilities, or obligations arising from the use of the platform.

24. Force Majeure

The company shall not be held responsible for delays, interruptions, failures, or inability to perform obligations under these Terms of Use due to events beyond its reasonable control. Such events may include natural disasters, acts of terrorism, civil disturbances, war, government actions, pandemics, labor disputes, infrastructure failures, system interruptions, power outages, cyberattacks, or disruptions caused by third-party providers. During such periods, the company’s obligations shall be suspended to the extent impacted by the force majeure event. The user acknowledges that such circumstances may affect access to the platform, communication performance, analytics accuracy, data processing, or integration functionality.

Once the force majeure event subsides, the company shall resume operations as soon as reasonably practicable. The company is not required to provide compensation, refunds, or liability coverage for service disruptions arising from such events. Users are encouraged to maintain contingency procedures and backups to mitigate potential operational impacts. The company may, at its discretion, modify service availability, implement emergency measures, or temporarily suspend certain features in order to protect platform infrastructure during such events. These provisions ensure fairness and clarity when unforeseeable external events affect platform stability.

25. Entire Agreement

These Terms of Use constitute the complete and exclusive agreement between the user and the company regarding the access to and use of the Globe Communication platform. They supersede all prior agreements, discussions, communications, proposals, and understandings, whether written or oral, relating to the subject matter herein. No external representations, marketing statements, or prior commitments shall modify or expand the obligations defined in these Terms unless expressly incorporated through a formal written amendment executed by the company.

The user acknowledges that they have not relied on any statement, promise, or representation outside of these Terms in deciding to use the platform. If the company introduces supplemental policies, guidelines, or service-specific terms, those documents shall be considered integrated into this agreement upon publication. Any amendments must be approved and issued by the company in a clearly documented format. Continued use of the service constitutes acceptance of the entirety of this agreement and any lawfully introduced updates. This section ensures that all obligations and rights are consolidated into a single authoritative document governing the relationship between the parties.
